Mistrial Declared in Harvey Weinstein’s Third New York Rape Trial

Manhattan jury deadlocks on charge that he raped Jessica Mann in a 2013 hotel room; retrial had been under way since April

A New York jury failed to reach a unanimous verdict on a third-degree rape count accusing Harvey Weinstein of raping actress Jessica Mann in 2013, prompting a judge to declare a mistrial in the producer’s third criminal trial in the state. Weinstein, 74, has denied the allegation and has prior convictions in other jurisdictions that remain subject to appeals and pending sentencing.

Mistrial Declared in Harvey Weinstein’s Third New York Rape Trial

Key Points

  • A Manhattan jury deadlocked on the third-degree rape charge alleging Harvey Weinstein raped Jessica Mann in 2013, and Judge Curtis Farber declared a mistrial.
  • Weinstein, 74, pleaded not guilty to the charge; his lawyers contend Mann fabricated the allegation after a consensual relationship did not aid her career.
  • Weinstein has prior convictions and legal actions in New York and California - including a 2022 California rape conviction (16-year sentence being appealed) and a June 2025 New York conviction for sexually abusing Miriam Haley, which could carry up to 25 years at sentencing - affecting the legal and entertainment sectors.

A third criminal proceeding in New York against Harvey Weinstein ended without a verdict on Friday after jurors were unable to agree on one of the central charges, a judge said.

The Manhattan case focused on an allegation that Weinstein raped Jessica Mann in a Manhattan hotel room in 2013 while Mann resisted and repeatedly said "No." Weinstein, 74, pleaded not guilty to a single count of third-degree rape and has denied assaulting anyone or engaging in non-consensual sex. His defense has maintained that Mann invented the accusation after regretting a consensual relationship that did not advance her film career.

Judge Curtis Farber declared a mistrial on the third-degree rape charge after the jury deadlocked. The proceeding was the third New York trial of the former film producer, who rose to prominence as a top figure in Hollywood before allegations of sexual misconduct ended his career and contributed to a broader social movement encouraging women to speak out about abuse by powerful men.

The case was brought by the Manhattan district attorney's office and centered solely on the allegation involving Mann. The retrial had begun in April and reached its impasse when jurors could not find unanimity on the rape count, prompting the judge to end the matter without a verdict on that charge.

This trial followed earlier legal actions involving Weinstein. In New York in 2020 he was convicted on counts that included the rape of Mann and an assault on a former production assistant, Miriam Haley, in 2006. The state's highest court later vacated that conviction and the associated 23-year prison sentence on the grounds that Weinstein had not received a fair trial.

Subsequently, a Manhattan jury convicted Weinstein of sexually abusing Miriam Haley at a trial in June 2025, while finding him not guilty of assaulting former model Kaja Sokola. Weinstein faces up to 25 years in prison for the Haley conviction at his forthcoming sentencing.

Separately, Weinstein was convicted of rape in California in 2022 and is serving a 16-year sentence there; he is appealing that conviction and sentence. The New York mistrial leaves the specific third-degree rape allegation involving Mann without a jury resolution at this time.

Case timeline - as presented at trial

  • Alleged incident: Mann says she was raped in a Manhattan hotel room in 2013 while resisting and saying "No."
  • Charge in New York retrial: One count of third-degree rape; Weinstein pleaded not guilty.
  • Judge: Curtis Farber declared a mistrial after the jury deadlocked on that count.
  • Related convictions: A prior New York conviction from 2020 was overturned; a June 2025 conviction for sexually abusing Miriam Haley remains and carries up to 25 years at sentencing; a 2022 California rape conviction resulted in a 16-year sentence that is being appealed.

Risks

  • Legal uncertainty from the mistrial - the unresolved New York rape charge leaves open the possibility of future proceedings and continued legal costs and liabilities for Weinstein, affecting the legal sector and court resources.
  • Ongoing appeals and pending sentencing in multiple jurisdictions - Weinstein is appealing a California conviction and faces sentencing for the Haley conviction in New York, creating continued uncertainty for corrections and criminal justice administration.
  • Reputational and industry impacts - sustained high-profile proceedings against a former top film producer maintain reputational risks for associated entities in the entertainment sector and may affect related civil or administrative matters.
